1. Introduction

Welcome to YovaPay. These Terms of Service ("Terms") govern your access to and use of YovaPay's services, including our website, mobile applications, and payment services (collectively, the "Services"). YovaPay is a technology platform operated by YovaPay LTD (Rwanda) and Yova Pay LTD (UK).

By using our Services, you agree to these Terms. Please read them carefully.

2. Service Description

YovaPay is a technology platform that facilitates remittance services through licensed partners. We are not a bank or payment provider. Our Services include:

• Virtual USD and EUR account issuance
• Money transfer services to Rwanda and DRC
• Mobile money payouts in Rwanda and DRC
• Stablecoin payment processing across multiple blockchain networks

3. Eligibility

To use our Services, you must:

• Be at least 18 years old
• Have legal capacity to enter into a binding contract
• Reside in an eligible jurisdiction (US, UK, EU, Rwanda, or DRC)
• Comply with all applicable laws and regulations

4. Account Registration

When creating an account, you must:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

5. Service Limitations

Please note the following service limitations:

• Virtual USD accounts cannot be issued for users in DRC
• EUR virtual accounts only support first-party payments from European residents
• Settlement times vary by payment method (48 hours for ACH, same day for Fedwire and SEPA Instant)
• SEPA Credit is only available for transactions above 100,000 EUR

6. Fees and Charges

All applicable fees will be clearly disclosed before you complete a transaction. You agree to pay all fees associated with your use of the Services.

7. Compliance and KYC

You agree to:

• Provide required identification documents
• Submit to our Know Your Customer (KYC) procedures
• Comply with anti-money laundering regulations
• Use the Services only for legitimate purposes

8. Prohibited Activities

You may not use our Services to:

• Violate any laws or regulations
• Engage in fraudulent activities
• Conduct unauthorized commercial activities
• Circumvent our security measures

9. Intellectual Property

All content, features, and functionality of our Services are owned by YovaPay and protected by international copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, YovaPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Services.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through our Services. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Rwanda and the United Kingdom, as applicable to your jurisdiction of residence and use of the Services.
